Transfer-on-death deeds allow a property owner to avoid probate. A new deed is prepared on the specific property. The benefits of a transfer-on-death deed include:

  • Original owner maintains full ownership until death.
  • Original owner can refinance or sell the property.

At the passing of the original owner, the children or whomever party was designated as the new owner may present a death certificate and an affidavit stating he or she is listed on the deed and file the documents with the county recorder’s office. A new deed will be issued to the new owners without going through probate.
